In case of conflict between language versions, the English version prevails for international customers; the German version prevails for Swiss customers.
Overview
This website www.moud.swiss is operated by M'OUD Switzerland GmbH, Bramenring 19, 8302 Kloten, Switzerland (relocation of the registered office from Kollbrunn ZH to Kloten ZH filed with the Commercial Register). Throughout the site, the terms “we”, “us” and “our” refer to M'OUD Switzerland GmbH. The company is registered with the Commercial Register of the Canton of Zürich under UID CHE-215.784.601.
By accessing our website and/or purchasing a product, you agree to these Terms & Conditions (“Terms”). These Terms apply to all users of the site.
1. Scope
These Terms apply to all orders placed via www.moud.swiss. Conflicting terms shall not apply unless expressly acknowledged by us in writing.

3. Formation of Contract
The presentation of products on the website does not constitute a binding offer. A purchase contract is concluded once we accept your order by email confirmation or by shipping the goods. The order becomes binding once you click the “Place order” button.
If a product becomes unavailable between order receipt and confirmation, we will inform you immediately and any payment already received will be refunded.
4. Prices and Taxes
Prices are displayed in the currency of your market, for example Swiss Francs (CHF) for Swiss customers and UAE Dirhams (AED) for customers in the UAE. The price applicable is the price displayed at the time of order.
Swiss VAT: M'OUD Switzerland GmbH is not liable for Swiss VAT. No VAT is shown or charged.
UAE VAT: The company is not registered for VAT in the United Arab Emirates. GCC orders are processed without VAT.
5. Payment Methods
You can see the available payment methods in the checkout. Payment is authorized and captured at the time of order completion. For pre-order items, the provisions in Section 7 apply.
6. Delivery and Shipping
Shipping regions: We deliver to the countries that can be selected in the ordering process (checkout). Current delivery areas, shipping costs and delivery times are listed on the Shipping and returns page. For countries we do not yet deliver to, you can join the waiting list.
Shipping costs: Shipping costs depend on the destination country and the order value and are listed under Shipping and returns. The effective shipping cost is shown in the checkout before payment.
Delivery times: Delivery times depend on the destination country and are listed on the Shipping and returns page. Every shipment is insured and tracked. For pre-order items, the provisions in Section 7 apply.
Customs and import: For deliveries outside Switzerland, any import duties, taxes or fees are the responsibility of the recipient.
7. Pre-Orders
Items marked as “Pre-Order” are produced in small batches and shipped on the estimated delivery date communicated on the product page.
7.1 Combined orders: If an order contains both in-stock items and pre-order items, all items are shipped together once the pre-order is fulfilled. On request, we ship in two tranches; please email info@moud.swiss.
7.2 Right to cancel: Pre-orders may be cancelled free of charge at any time before shipment. Refund will be processed within 10 business days to the original payment method.
7.3 Production failure: If a pre-ordered item cannot be produced by the communicated delivery date, we will inform you immediately by email. You may either accept a new delivery date or request a full refund within 10 business days.
7.4 Delay over 30 days: If the delivery is delayed more than 30 days beyond the originally communicated date, you have the right to terminate the contract immediately and receive a full refund.
7.5 Numbered editions: For numbered editions (e.g. Oud Amal Intense, 1,000 numbered bottles), numbers are allocated in order of receipt. A specific number cannot be guaranteed unless confirmed in writing.
8. Returns, Withdrawal and Refunds
Statutory right of withdrawal (EU, EEA, UK): Consumers domiciled in the European Union, the European Economic Area or the United Kingdom additionally have the statutory right of withdrawal of 14 days. The conditions of the voluntary return below do not restrict it; only sealed goods whose seal was opened after delivery are excluded. Withdrawal instructions and the model withdrawal form: Right of withdrawal.
Voluntary return, 14 days (Switzerland and all other countries): You may return products within 14 days of receipt provided they meet the return conditions below. A receipt or proof of purchase is required.
Return conditions for the voluntary return, the product must be:
- Unopened: the protective seal must be intact
- Unused: not sprayed, swatched, applied, or tested in any way
- Undamaged: no scratches, dents, marks or wear on bottle, packaging, box, or printed materials
- In original packaging: with all inserts, certificates, numbered cards, ribbons, seals and outer boxes
Items that do not meet these conditions will be refused and returned to you at your expense, with no refund issued.
Return shipping costs: The customer bears the cost of return shipping. We recommend insured tracked shipping; we are not liable for items lost or damaged in return transit. Exception: if the return is due to a defect on our side or a wrong item shipped, we cover the return shipping in full.
How to initiate a return: email info@moud.swiss with your order number. We respond with return instructions within 2 business days. Please do not send anything back before you have received these instructions; unannounced returns cannot be accepted.

Items excluded from return:
- Opened or used perfumes (hygiene products under Swiss and EU law)
- Custom-made or personalised items
- Gift cards and Discovery credits
- Pre-order items after shipment (cancellation under Section 7.2 only possible before shipment)
Numbered editions, no exchange: For numbered editions, exchange is excluded due to availability constraints. For valid defects, please email photos and description to info@moud.swiss.
Damages and issues: Please inspect your order upon receipt. Defective, damaged, or incorrect items must be reported within 7 days of delivery, with photos.
Refund processing: Approved refunds are processed within 10 business days after receipt and inspection of the returned goods, to the original payment method. Bank processing time may add 3–5 days.
9. Retention of Title
Goods remain our property until full payment of the purchase price has been received.
10. Credits and Gift Cards
Promotional credits may only be redeemed once during the indicated period and cannot be combined with gift cards. The Discovery credit is sent as a code by email once the Discovery Set has been delivered, is valid for 37 days from that email, can be applied once to your first 100 ml bottle (any fragrance) and is not transferable. Gift cards are valid for 3 years from purchase, are transferable and are not redeemable for cash.
11. Privacy
Your personal data is processed in accordance with our Privacy Policy. Both the Swiss Federal Act on Data Protection (revFADP) and the EU General Data Protection Regulation (GDPR) apply for EU customers.
12. Liability and Warranty
Statutory provisions apply. We are liable only for damages caused by intent or gross negligence. For slight negligence we are liable only for breach of essential contractual obligations and only for the typical, foreseeable damage. Liability for indirect damages, consequential damages or loss of profit is excluded to the extent permitted by law.
13. Dispute Resolution
EU customers: We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
Swiss customers: Disputes are subject to the ordinary courts in accordance with Section 14.
14. Governing Law and Jurisdiction
Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) and the rules of conflict of laws. The exclusive place of jurisdiction is Zürich, Switzerland.
15. Language
These Terms are available in English and German. The English version is binding for international customers. The German version is binding for Swiss customers. In case of contradiction or interpretation issues, the language version corresponding to the customer's market prevails.
16. Severability
Should individual provisions of these Terms be or become invalid, unenforceable or void in whole or in part, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by the valid provision that comes closest to the economic purpose of the invalid provision.
17. Amendments
We reserve the right to amend these Terms at any time. The current version is available at www.moud.swiss/pages/agb. For orders already placed, the version of the Terms in effect at the time of the order applies.
